IHC orders to register FIR against police officials on detention of citizen

Islamabad: The Islamabad High Court (IHC) on Monday ordered the police to register a case against the Superintendent Police CTD, SHO Secretariat and other police officials in a case against for allegedly keeping a citizen in illegal detention.



The IHC’s Justice Mohsin Akhtar Kayani heard the case wherein DSP Legal Islamabad Police appeared before the court.



The DSP legal proposed that the department would form a joint investigation team (JIT) on alleged illegal detention of citizen Ali Muhammad. Justice Mohsin Akhtar Kayani rejected the request and remarked that there is no JIT, if one person can understand a matter, then there is no need for three.



He questioned that has there ever been an investigation without registering an FIR? Justice Kayani of the Islamabad High Court heard the petition of the father of citizen Ali Muhammad. The court was informed that the statement of Ali Muhammad, who was allegedly kept in illegal detention by the police, has been recorded before the magistrate.



Petitioner’s lawyer Sher Afzal Marwat read out Ali Muhammad’s statement under 164. DSP Legal said that we have not yet received a copy of Ali Muhammad’s Section 164 statement. Justice Mohsin Akhtar Kayani remarked that he should tell the IG to register a case against the police officials upon receiving this copy and arrest all the accused officials including the SP CTD.



The court instructed that an FIR should be registered by the next hearing. Then we will see where the investigation goes, If they are innocent, it would be cleared in investigation, he said. The court directed that the IG Islamabad should report on the next hearing as to what action he took.



The court said that the IG will be called at the next hearing and then we will see who should conduct the investigation.The court ordered the registration of a case and adjourned the hearing of the case till March 11.
