IHC restrains CDA from removing graveyard in Sector D-12

Islamabad

ISLAMABAD:The Islamabad High Court (IHC) has restrained the Capital Development Authority (CDA) from taking further action affecting an ancestral graveyard in Sector D-12 and sought a written response from the authority on a petition challenging its proposed removal.

Justice Muhammad Azam Khan issued the written order while hearing a petition filed by Waqar Ahmed, who approached the court to protect the graveyard in Mouza Seri Saral, Sector D-12, Islamabad.

According to the petitioner, the graveyard adjacent to Elahi Mosque contains the graves of his ancestors and those of other local residents. He requested the court to restrain the CDA from carrying out development work, constructing roads or levelling the land in a manner that could affect the burial site.

The petitioner’s counsel submitted that revenue records, survey reports and Google Maps images also identified the site as a graveyard and a place for funeral prayers.

The counsel requested the court to order the installation of fencing and demarcation around the graveyard to protect the burial site and ensure its preservation before any development work commenced in the area.

The court directed that the existing status of the graveyard be maintained and sought a written response from the CDA.

The matter is scheduled for further hearing on October 28.
