PESHAWAR: Secretary Home and Tribal Affairs, Ikramullah Khan on Monday said that Alternate Dispute Resolution (ADR) was a mechanism for speedy and cheap dispensation of justice to reduce the burden of caseload on the judiciary.
He said that a single uniform mechanism ADR in both criminal and civil cases is compatible with our judicial system and district administration and police can also refer cases to ADR.
Talking to reporter about the salient feature of the ADR system, he said that it was a court-annexed regime but people were allowed to approach “Saliseen”(mediators) on their own, and district administration and police could also refer cases to ADR.
He said that settlement and decision as a result of ADR would be submitted to the court which shall pronounce judgment and pass a decree, adding no appeal or revision against such decree was admissible.
“If a case has not been resolved by ADR, the court shall adjudicate in accordance with the law.
The Saliseen (mediators) selection committee comprises of Commissioner of the division as Chairman and other members include regional police officer, senior civil judge (Admin) of concerned district, a representative of law enforcement agencies, regional director protestation, representative of special branch and deputy commissioner of the district concerned.
There are 50 Saliseen (mediators) for each district and Deputy Commissioner shall draw a list of Saliseen (mediators) based on the selection criteria for the retired judicial officers, civil servants, lawyers, experts, ulema, and notable of the locality.
Deputy Commission shall verify the list to the effect of their integrity through the district intelligence Coordination Committee and will submit the verified list to the Saliseen (mediators) selection Committee.
